中文摘要：随着人类进入数字时代,不同场景中的用户画像技术根据不同的用户信息抽象出标签化的用户模型。用户画像技术让数据具有了价值,凸显了大数据时代人的“数字属性”,也型塑了数字时代的公民数字身份。然而,用户画像技术在给人类带来舒适、便利和个性化服务的同时,也造成了限制公民自主权、侵犯公民知情权、隐私权、平等权及对人的过度监控等方面的人权保护困境。鉴于数字时代人权侵犯方式的技术化和自动化,立足用户画像中人权保护的法治化进程,需要与时俱进更新人权保护理念,从构建个人赋权、平台责任与国家监管的权益平衡机制、构筑用户画像中的人权协同保护体系、保证用户画像中的数据公正和第三方身份的技术监督四个方面,探索用户画像中的新型人权保护策略,加强和促进用户画像中的人权保护。这无疑是数字时代人权保护的重要课题。

外文摘要：As human beings enter the digital age,user portrait technologies in different scenes abstract tagged user models according to different user information.User portrait technology makes data valuable,highlights people’s“digital attributes”in the era of big data,and also shapes citizens’digital identity in the digital age.However,while user portrait technology brings comfort,convenience and personalized service to human beings,it also causes the dilemma of human rights protection in terms of restricting citizens’autonomy,infringing citizens’right to know,privacy,equality and excessive monitoring of people.In view of the technicalization and automation of human rights violations in the digital age,based on the legalization process of human rights protection in user portraits,it is necessary to keep pace with the times and update the concept of human rights protection.It is necessary to explore new human rights protection strategies in user portraits from four aspects:building a balance mechanism between individual empowerment,platform responsibility and state supervision,building a human rights collaborative protection system in user portraits,ensuring data fairness in user portraits and technical supervision of third party identities,and strengthening and promoting human rights protection in user portraits.This is undoubtedly an important topic of human rights protection in the digital age.
