中文摘要：处理高校学生伤亡事故的法律法规比较凌乱,给事故的处理带来一定障碍。运用比较分析法、文献分析法对高校学生伤亡事故法律关系和民事责任的性质及其归责原则综合论证,结论表明,高校与高校学生法律关系是行政关系和民事关系并存,民事法律责任的性质为违约责任和侵权责任竞合。其侵权责任的归责原则是多元化的,归责原则应与《民通》保持一致。赔偿范围应严格依据《人身损害赔偿司法解释》和《精神损害赔偿司法解释》确定。

外文摘要：Laws and statutes of handling the colleges and universities students’ casualty accident are comparatively messy, which bring certain obstacle to the accident treatment. The legal relation between colleges and students of colleges are administrative and civil relation. Whose civil legal liability character is the responsibility breaking a contract and the strong tort responsibility. Expounding and proving whose tort responsibility imputation is to diversify ,and to coincide “General Principles of Civil Law”.
