中文摘要：基因科技是开启人类生命之门的钥匙。生命科技的发展引发新兴权利的出现,基因科技的迅速发展引发基因权利的产生。人类体外胚胎是人工辅助生殖技术发展的产物,其属性在现实法律语境中尚不明确。体外胚胎是"自然法则意义上的人",具有发展成为人的潜能,含有一定的人格利益属性,是基因遗传权的客体。将基因遗传权定位为法律权利,完善基因遗传权立法体系,健全司法救济程序,同时建立体外胚胎救济制度,是实现体外胚胎基因遗传权法律保护的有效途径。

外文摘要：Gene technology is the key to understand the secret of human life.The development of life science and technology has led to the emergence of new rights,and the rapid development of genetic technology has led to the emergence of genetic rights.Artificial assisted reproduction technology is a field of life science and technology.In vitro embryo is the product of the development of artificial assisted reproductive technology.Its attributes are not clear in the real legal context.Embryos in vitro are "human beings in the sense of natural law".They have the potential to develop into human beings,contain certain personality interests,and are the object of genetic rights.It is an effective way to realize the legal protection of genetic rights of embryos in vitro by positioning genetic rights as legal rights,improving the legislative system of genetic rights,improving judicial relief procedures and establishing an in vitro embryo relief system.
