中文摘要：乡村振兴战略是党和国家的重大战略部署,是实现中华民族伟大复兴的重大战略。农村土地制度作为农村相关制度体系的基础,其能否有效解决农村的问题,是进一步推进乡村振兴战略的关键。农村土地"三权分置"制度作为农村土地制度改革过程中的一项重大成果,其制度本身还存在着不完善之处,在现实推行过程中也存在问题。本文通过分析《农村土地承包法》和《民法典》物权编中关于农村土地"三权分置"制度的缺陷及其现实问题,提出保护土地经营权人合法权益、增设空地费、土地修复机制、土地制度推广宣传和确权登记发证的解决建议,希望通过"三权分置"制度的相关保障机制推进我国乡村振兴战略的发展进程。

外文摘要：The rural revitalization strategy is a major strategic deployment of the party and the country,and a major strategy for the overall rejuvenation of the Chinese nation.The rural land system is the foundation of the rural related institutional system.Whether it can effectively solve the rural problems is a key measure to further promote the rural revitalization strategy.As a major achievement in the reform of the rural land system,the“three-rights separation”system of rural land has its own imperfections,and there are also many problems in the actual implementation process.This paper analyzes the system defects and practical problems of the“Three Rights Separation”system of rural land in the“Rural Land Contract Law”and the“Civil Code”Property Rights Edition,and proposes to protect the legitimate rights and interests of land management rights holders,add vacant land fees,and land Remediation mechanism,land system promotion and publicity,right confirmation,registration and issuance of solutions,This article hopes to promote the development process of my country’s rural revitalization strategy through the relevant guarantee mechanism of the“three power separation”system.
