中文摘要：我国领海外管辖海域指毗连区、专属经济区、大陆架以及国家管辖的其他海域,其刑事立法问题的起因是国家海洋发展战略的实施和世界海洋争夺战的升级,目的是用刑法手段实施国家海洋发展战略和维护国家主权与海洋权益。目前,我国领海外国家管辖海域刑事立法存在刑法典与专门海洋法律及涉海法律对刑法适用范围规定不协调、涉海司法解释越权等问题,解决这些问题需树立对国家管辖的各种海域"平等保护"理念,明确我国领海外国家管辖海域刑事立法的主要内容,在刑法总则增加在"中华人民共和国领海外国家管辖海域内实施的犯罪,适用本法"的规定,及根据海上犯罪特征和我国缔结或者参加国际条约所规定的犯罪,设置相应的特殊罪名。

外文摘要：The sea areas under the jurisdiction of China over territorial sea constitute of contiguous zone, ex-clusive economic zone, continental sheK and other sea areas under the jurisdiction of the state. The reason why we research the problems of criminal legislation to these sea areas is that the national marine development strategy is being implemented and the world ocean batde is going up, and the purpose is to implement the na-tional marine development strategy and safeguard national sovereignty and maritime rights by means of crimi-nal law. At present, there are some problems of criminal legislation to sea areas under the jurisdiction of China over territorial sea, such as applicable scope being not coordinated in criminal law, special law of marine and sea related legal provisions, and the judicial interpretation involving ultra vires. To solve above problems, we should establish the concept of ＂equal protection＂ in various sea areas under the jurisdiction of the state, make it clear the main contents of the criminal legislation in the jurisdiction of the overseas countries, add it in the general provisions of the criminal law ＂Crimes committed in the sea areas under the jurisdiction of the People＊ s Republic of China are applicable to this law＂. According to the characteristics of maritime crimes and the crimes stipulated in our country or in the international treaties, we should set up corresponding special charges.
