中文摘要：行政审批权力清单作为政府行政管理体制改革的一项重要措施,不仅关乎国家治理问题,而且承载着行政法治建设的重任。目前,各级政府制定的行政审批权力清单主要是清权或放权,缺乏相应的民主程序和监督机制,未对行政权力结构进行调整,且对行政审批权力清单存在误读现象。因此,应理性看待行政审批权力清单的法治内涵及其局限性,从法理上理清行政审批权力清单的形式正义和实质正义,构建行政审批权力清单的法治路径。

外文摘要：As an important measure of the reform of the government administration,administrative examination and ap- proval power list is not only related with the national governance issues ,but also carries the important task of the con- struction of administrative rule by law.At present,the list of administrative examination and approval power of all levels of government is mainly about clearing right or decentralization,lack of democratic procedures and the supervision mechanism,not to administrative power structure adjustment,and misreading the list of administrative examination and approval authority.We should look at the connotation of rule of law and limitations of the list of administrative examina- tion and approval authority;clarify its formal justice and substantive justice from the legal principle,in order to build the path of rule of law of the list of administrative examination and approval authority.
