中文摘要：人工智能时代,智慧司法实施的核心价值是提高司法效率,实现司法公正。理性认识人工智能技术介入司法的边界,对智慧司法的良好实施至关重要。通过分析国内外人工智能技术在司法中的多领域运用认为,智能技术司法运用的局限性导致人工智能介入司法不可避免地带来司法过程对技术的过度依赖、算法黑箱影响司法公开、数据裁决的算法歧视等一系列风险。面对智慧司法可能带来的风险和挑战,司法机关需要在严格把握人工智能介入司法边界的基础上,建立事前评估和事后检验相结合的算法论证规则,设立完善的算法解释规则,嵌入案件预警纠偏机制,并探索运用区块链技术,对智慧司法实施的风险进行有效地法律规制,保障智慧司法在法治轨道上理性推进,从而实现有效率的正义。

外文摘要：In the era of artificial intelligence,the core value of intelligent justice is to improve judicial efficiency and realize judicial justice.Rational understanding of the boundary of artificial intelligence technology intervening in justice is of great importance to the good implementation of intelligent justice.Based on the analysis of the application of artificial intelligence technology in many fields of judicature at home and abroad,this paper holds that the limitation of judicial application of intelligent technology leads to the intervention of artificial intelligence in judicature,which inevitably brings a series of risks such as excessive dependence on technology in judicial process,black-box algorithm affecting judicial publicity,algorithm discrimination in data adjudication,etc.Faced with the risks and challenges that intelligent justice may bring,the judicial organs need to strictly grasp the intervention of artificial intelligence in the judicial boundary,establish the algorithm demonstration rules combining prior assessment and back testing,set up perfect algorithm interpretation rules,embed the case early warning and correction mechanism,and explore the use of block chain technology to effectively regulate the risks in the implementation of intelligent justice,so as to ensure the rational advancement of intelligent justice on the track of the rule of law,thus realizing efficient justice.
