中文摘要：低价倾销是经营者的一种低价商业行为或竞争策略,其低于成本价的定价机制因不可能盈利不具有经济上的合理性,但低于成本价使经营者获得竞争优势,特别是其光环效应能提升经营者的整体竞争力,争取到其公平竞争条件下不可能获得的竞争利益,或者争取了其他经营者预期的合理利润,而且低价倾销常伴着价格虚假宣传、价格欺诈和价格歧视等不正当价格行为,其正当性值得商榷。我国学界和实践中把低价倾销与掠夺性定价相混淆,或是把低价倾销等同于自主定价不主张进行规制,导致实践中低价倾销违法行为难以追究其法律责任。应明确界定低价倾销的“不正当性”和掠夺性定价的“垄断性”,确立低价倾销的认定新标准,应完善《反不正当竞争法》,建立规制低价倾销的法律机制。

外文摘要：Low-price dumping is a kind of low-cost business behavior or competitive strategy for the operator.Its pricing mechanism below the cost price is not economically reasonable because it is impossible to make profits,but below the cost price gives the operator a competitive advantage.Especially its halo effect can improve the overall competitiveness of the operator,win the competitive benefits that are impossible to obtain under its fair competition conditions,or fight for the reasonable profit expected by other operators,and low-price dumping is often accompanied by false price promotion,price fraud and price discrimination and other unfair price behaviors,which is questionable in the legitimacy.The academic circles and practice in our country confuse low-price dumping with predatory pricing,or equate low-price dumping with autonomous price and do not advocate regulation,which makes it difficult to pursue legal liability for illegal acts of low-price dumping in practice.The“unfairness”of low-price dumping and the“monopoly”of predatory pricing should be clearly defined,new standards for low-price dumping should be established,the“Anti-Unfair Competition Law”should be improved,and a legal mechanism to regulate low-price dumping should be established.
