中文摘要：近年来,作为检察机关参与执法监督、制止和预防行政违法、保障并促进法治政府实现的一种重要机制,执法检察建议在取得良好监督和社会管理效果的同时,实践运作中确也暴露出制发不规范、强制力不足、质量不高等诸多问题。执法检察建议机制的法治化是法治国家全面推进的必然要求,也是解决问题实现其运行规范化的重要途径。应该在由最高国家权力机关在我国《人民检察院组织法》中设置执法检察建议机制,同时须细化并充实执法检察建议权的具体内容、明确其适用的基本原则、构建其运作的基本程序。

外文摘要：In recent years, as an important mechanism for procuratorial organs to participate in law enforcement supervision, stop and prevent administration illegal administration, guarantee and promote the realization of the law-based government, the procuratorial suggestion on law enforcement has actually showed many problems in the practial operation such as disstandard issurance, in sufficiency of binding effect and low quality when achieving good effcct of supervision and social governance. The legalization of mechanism of procaratorial suggeetion on law enforcement is an inevitable requirement for the comprehensive promotion of the law-based country and also the only solution to the problems so as to realize the normalization of its operation. The supreme organ of state power should set up the mechanism of procuratorial suggestion on law enforcement in Law on Organization of People＇ s Procuratorate of PRC and give details of the content of procuratorial power to issue suggestion on law enforcement, clarify the basic principles of its application, establish the basic procedures of its operation.
