中文摘要：行政机关“不依法履行职责”之认定贯穿于环境行政公益诉讼制度运行的全过程,而并非只存在于起诉或诉讼程序中。应从履职范围、履职期限、履职程度三个逐步递进的维度来认定行政机关“不依法履行职责”。环境行政公益诉讼中行政机关的“监督管理职责”应类型化为监督职责与具体微观的管理职责,不包含抽象宏观的管理职责;对生效行政决定的履行监督应纳入履职范围;逾期未回复检察建议应被排除在“不依法履行职责”认定的履职范围之外。履职期限分为程序性履职期限和实体性履职期限,二者在不同阶段或单独存在或同时并存,导致不同阶段的履职期限计算规则有所区别。履职程度之认定应考察行政行为与结果二要素,二者的适用存在先结果后行为的顺位,且不同阶段各有偏重。

外文摘要：The identification of “failure to perform duties according to law” of administrative organs runs through the whole process of the operation of environmental administrative public interest litigation system rather than in litigation or litigation procedures only.We should identify the administrative organ “failure to perform duties according to law” from three progressive dimensions: the scope of duty performance, the period of duty performance and the degree of duty performance.In environmental administrative public interest litigation, the “supervision and management responsibilities” of administrative organs should be classified into supervision responsibilities and specific micro management responsibilities, excluding abstract macro management responsibilities. The supervision of the implementation of effective administrative decisions shall be included in the scope of duty performance. Failure to reply to the procuratorial suggestions within the time limit shall be excluded from the scope of responsibilities identified as “failure to perform duties according to law”.The performance period is divided into procedural performance period and substantive performance period, which exist separately or coexist at different stages, resulting in different calculation rules of performance period at different stages.The identification of the degree of duty performance should examine the two elements of administrative behavior and result.The application of the two elements has the order of first result and then behavior, and there is a bias in different stages.
