中文摘要：权利设置的目的是为了克服利益冲突。但法律的局限性使得法律规则系统出现种种漏洞,使得利益冲突并未能完全消除反而转化为权利冲突。在法律意义上,一般通过立法途径消除或减少权利冲突,通过司法裁判途径最终解决权利冲突。

外文摘要：The collision of right is actually that of interest,but its direct reason is the localization of law. The collision of right can not only lead to the collision between legal right and non-legal right,but also collision between legal rights within legal system. Although up to now there are no applicable rules of law,judicial judgment is necessary indispensable.
