中文摘要：跨国保护知识产权是经济全球化催生的产物。在知识产权事项上各国对立法管辖权、司法管辖权和行政管辖权的固守耽误了跨国合作的步伐。知识产权的跨国保护引起各国管辖权的现实冲突。知识产权持有人的国籍国、原始权利取得国与侵权行为地所在国发生的管辖权冲突,需要从国家主权意志的协调、国际公约的实施机制、国内立法、法院管辖权的主动克制等多个层次予以协调。

外文摘要：The cross-border protection of intellectual property rights has been a baby of economic globalization.The control of legislative,judicial and administrative jurisdiction has defaulted or hindered the step of international cooperation.The cross-border protection of intellectual property rights has aroused the real conflict in national jurisdiction.The conflicts arising from right holder＇s mother nation,country of origin of rights and the place of infringement have to be settled by the methods of coordination of sovereign wills,the enforcement of international conventions,national legislations,the self-restriction of jurisdiction by courts,used for three different kinds and characteristics of conflict in jurisdiction.
