中文摘要：全球气候变暖给人类社会生活造成了巨大冲击。合作减排以应对气候变化成为国际气候谈判的核心议程。由于哥本哈根气候大会取得的成果有限,全球气候谈判几乎陷入停滞状态,需要从新的视角思考减缓气候变化的政策问题。进入21世纪以来西方学者率先从环境、伦理与人权角度思考应对气候变化的可能路径。研究表明气候变化对人权造成的冲击日益加剧且难以在短期内消除其不利后果。在人权成为普世价值的当今世界,基于国际人权法的性质探索国家在气候变化语境里应该承担的人权义务,从而构建起人权保护与应对气候变化互动关系的理想图景。

外文摘要：Global warming has resulted in great changes in human society, and cooperation in the mitigation of the greenhouse effect has been a core agenda. Copenhagen Conference with limited results demonstrated a stalling of global climate negotiation, and a new perspective is needed to produce better results. Ever since the 21st century Western scholars have made some tentative efforts to search for possible approaches from the perspectives of environment ethics and human rights. It＇s shown that the increasing negative effects produced by climate changes would not be eradicated instantly. Human right has been a universally recognized value. Based on the nature of international human rights law, this research discusses the duties to respect and protect human rights and construct an ideal picture of mutual interrelationship of human rights and climate change.
