中文摘要：随着城市化的进程,工业、娱乐等多途径用海的激增,渔业水域滩涂的征收征用行为日益频繁。在渔业水域滩涂征收征用过程中,对渔民不予补偿或补偿不合理、严重侵害渔民利益的情况较为突出。究其原因,主要是我国对渔业水域滩涂征收征用补偿的法律制度缺失。笔者从渔业水域滩涂征收征用的现状着手,分析存在问题的原因,并从渔业水域滩涂征收征用补偿的指导思想、主体、客体、条件、监督机制、综合保障、法律责任等方面展开论述,从法律构建的视角解决渔业水域滩涂征收征用补偿过程中产生的问题。

外文摘要：With township development, industry and entertainment has occupied more and more fishery water area, and its expropriation and confiscation has been a popular phenomenon. However, there was no or very little compensation to fishermen. It has heavily harmed fishermen benefit. Because that, there was no law of compensation for fishery water area expropriation and confiscation. The author has analyzed the situation of fishery water area expropriation and confiscation, and discussed the law of compensation for fishery water area expropriation and confiscation in the aspects of its objective, supervision mechanism, and integrated insurance.
