中文摘要:集体经营性建设用地入市法律制度的确立及实施,能够激活农村土地在生产力发展中的活力,为乡村全面振兴注入强大动力。现行集体经营性建设用地入市规则尚存在入市范围模糊、入市方式不够清晰、救济机制相对缺乏等问题。为力避因法律规则上的这些问题可能引发的实践混乱,确保集体经营性建设用地入市在法治轨道上顺畅运行,需要从集体经营性建设用地入市的范围、方式和权益保障救济机制等方面完善规则,构建科学理性的集体经营性建设用地入市法律制度。
外文摘要:The establishment and implementation of the legal system for the entry of collectively-operated commercial construction land into the market can activate the vitality of rural land in the development of productivity and inject strong impetus into the overall revitalization of the countryside.The current market entry rules for collectively-operated commercial construction land still have problems such as vague market entry scope,unclear market entry methods,and relative lack of relief mechanisms.In order to avoid practical confusion that may be caused by these problems in legal rules and ensure that the entry of collective commercial construction land into the market operates smoothly on the track of the rule of law,it is necessary to improve the rules in terms of the scope,method,rights protection and relief mechanism and construct a scientific and rational legal system for of the market entry of collectively-operated commercial construction land.
