中文摘要：海域征收补偿关系到渔区的稳定和发展。本文通过梳理相关的法律法规和理论，发现在当前的法律秩序下，地方政府在渔业用海征收补偿实践中承担着多重角色和复杂的职能。法律法规的倾向于普适性的描述特点和在具体实践中一般规则而非高度精确的描述使地方政府在实践中有较强的机会主义倾向。抛开制度中性的假设，渔业用海征收补偿制度有效率但不公平，渔民的不公平感来自与其他阶层以及群体内部的比较。从改善公平的角度考虑，地方政府可以从健全补偿对象资格认定、明确补偿标准的测算规则和范围、改善补偿救济制度几个方面完善渔业用海征收补偿制度体系。

外文摘要：The fishery sea levy compensation related to the stability and development of fishery communities. In this article, we have seen through combing relevant laws and theories that the local governments play multiple roles and assume complex responsibilities of levy compensation practices which is determined by the current legal framework. The local governments have not only a strong tendency to opportunism in practices because of the general rule of laws and regulations rather than making highly accurate description. Under the non-neutral institutional hypothesis, the fisheries sea levy compensation system is pareto efficiency but not fair. The unfair senses of fishermen result from the comparison with other classes as well as within groups. From the perspective of improving the fairness, the local government should draw up some policies of the perfection of compensation object qualification and clear measure rules and compensation relief system to improve fishery sea levy compensation institutional system.
