中文摘要：情感脑机接口技术通过对情感状态进行检测、识别、刺激和调控,在对人机交互方式产生深远影响的同时,也不可避免地带来情感监控、情感数据安全、知情同意及情感增强引发的“情感鸿沟”等方面的风险与挑战。由此,亟需在研究情感脑机接口技术的特殊性及其引发的复杂利益冲突与风险的基础上,从确立预期治理与动态风险评估机制、完善情感数据安全和隐私保护、建立分层披露与动态同意制度、强化非歧视原则与责任追究机制及探索神经权利的宪法化与部门法细化几个方面,对情感脑机接口技术的应用风险进行法律规制。构建兼顾工具理性和价值理性包容审慎的规制措施,加强和完善对情感脑机接口技术风险的法律规制是法律针对情感脑机接口技术侵害人类情感领域的风险做出积极回应、促进科技向善、保障人权的重要体现。

外文摘要：While emotional brain-computer interface(EBCI)technology profoundly impacts human-computer interaction by detecting,identifying,stimulating,and regulating emotional states,it also inevitably brings risks and challenges in areas such as emotional monitoring,emotional data security,informed consent,and the"emotional gap"brought about by emotional enhancement.Therefore,based on research into the particularities of EBCI technology and the complex conflicts of interest and risks it raises,it is imperative to establish legal regulation of the risks associated with the application of EBCI technology by establishing anticipatory governance and dynamic risk assessment mechanisms,improving emotional data security and privacy protection,establishing a tiered disclosure and dynamic consent system,strengthening the principle of non-discrimination and accountability mechanisms,and exploring the constitutionalization of neurological rights and the detailed development of departmental laws.Constructing regulatory measures that balance instrumental rationality and value rationality,inclusiveness,and prudence,and strengthening and improving legal regulation of the risks of EBCI technology are important manifestations of the law's proactive response to the risks of EBCI technology infringing on human emotions,promoting the use of science and technology for good,and safeguarding human rights.
