中文摘要：世界首例“人类基因编辑婴儿”事件引发世界关注的同时,也促使我们深入思考科技与法律、科技与人类尊严之间的关系。技术发展带来的系统性风险,使国家风险防控及社会治理任务空前沉重。人性尊严是宪法价值的基础和核心,宪法始终以维护人的尊严作为历史使命。宪法理应在人类基因编辑技术发展过程中起到主要规范作用。现代生物科技时代对宪法如何保障公民尊严、自由和基本权利提出了挑战。将技术发展纳入宪法治理的理性轨道,在科技发展与宪法价值之间寻求良性互动和合理平衡是生命科技时代各国面临的共同课题。通过将人类尊严的保护上升为宪法的法律意志,在未来制定的《基因科技法》中对人类基因编辑技术的应用进行专门规定,配合伦理治理于部门法中进行配套制度设计,由此构建宪法统领的保护人类基因编辑中人性尊严的社会主义法律体系。

外文摘要：While the world's first "human gene editing baby" incident has aroused world attention,it has also prompted us to think deeply about the relationship between science and technology and law,science and technology and human dignity.The systematic risks brought about by technological development make the task of national risk prevention and control and social governance unprecedented heavy.Human dignity is the foundation and core of the constitutional value.The constitution has always taken safeguarding human dignity as its historical mission.The constitution should play a major normative role in the development of human gene editing technology.The modern biotechnology era has challenged the constitution to protect citizens' dignity,freedom and basic rights.Bringing technological development into the rational track of constitutional governance and seeking a sound interaction and reasonable balance between technological development and constitutional value are common issues faced by all countries in the era of life science and technology.By elevating the protection of human dignity to the legal will of the constitution,the application of human gene editing technology will be specially stipulated in the future "gene science and technology law" and the matching system design will be carried out in the department law in cooperation with ethical governance,thus constructing the socialist legal system under the constitution to protect human dignity in human gene editing.
