中文摘要：环境标准"超期服役"折射出中国现行环境标准与环境管理客观需要的严重脱节,这一现象成为在环境标准制度中引入"日落条款"的直接动因。作为一种法律淘汰机制,"日落条款"的基本理念与环境标准的内在属性高度契合。在环境标准制度中设置"日落条款",可以平衡法的稳定性和灵动性之间的冲突,增强环境标准修订的可预见性并增加环境标准修订程序的正当性。唯有明确"日落"期限和期限届满效力、完善后评价制度和环境标准修订的程序规范,构建环境标准常规审查修订机制,才能实现环境标准制度的合目的性与合规律性的统一。

外文摘要：The ＂ overtime service ＂ of environmental standards reflects the serious disconnection between current environmental standards and the objective reality of environmental management, this phenomenon has become the direct cause of leading the ＂sunset clause＂ into the environmental standards system. As a kind of legal elimination mechanism, the basic idea of the ＂ sunset clause ＂ fits nicely the inherent property of environmental standards. It can balance the conflict between stability and flexibility of law, strengthen the predictability of environmental standards revision and increase the legitimacy of the revision procedure of environmental standards to set the ＂sunset clause＂ in the environmental standards system. Only by confirming the period of ＂sunset＂ and the validity of period expiration, perfecting the post evaluation system and the program specification of environmental standards revision, and constructing the routine mechanism of environmental standards review and revision, can it achieve the unity of purpose identification and regularity identification of the environmental standards system.
