中文摘要："权力清单"作为深化政府行政管理改革的一项重要措施,受到各级政府的重视。但事实上,目前各级政府推出的所谓"权力清单"主要是政府的行政审批清单,旨在规范政府的行政审批行为,但不论学界还是各级政府都存在对"权力清单"的误读,把行政审批清单作为"权力清单",把行政权简单化为行政审批权。行政职权是行政权力的具体化,"权力清单"是对行政职权运行的规范化和程序化。应理性看待行政职权与行政权力的关系,从法理上厘清行政权力的形式正义和实质正义,权力的制约机制和规范行政权力的法治路径,明确"负面清单"、"权力清单"和"责任清单"三个清单的法治路径。

外文摘要：The power list is an important measure to deepen the reform of government administration which bring to the attention of the governments at all levels. But in fact, the so - called power list of govern- ment at all levels is mainly the government＇ s administrative examination and approval list to regulate the ac- t/on of the government＇ s administrative examination and approval behavior. But both the academia and gov- ernments at all levels have misreading of the power list, and treat the list of administrative examination and approval as a list of power thus simplify the administrative power to the power of administrative examination and approval. Administrative authority is the embodiment of administrative power, the list of power is the standardization and procedure of the administrative authority. The relationship between administrative au- thority and administrative power should be treated rationally, and people should clarify the formal justice and substantive justice of administrative power from the perspective of jurisprudence, explain the restriction mechanism of power and the rule of law to regulate administrative power, clear the path to the rule of law of negative list, power list and responsibility list.
