中文摘要：壮族、藏族、维吾尔族、蒙古族、回族、瑶族等少数民族在长期生产生活中,尊重自然、保护自然,与自然和谐相处,形成了极具地域性、民族性、生态性的环境习惯。少数民族环境习惯在制裁方式、价值取向和保护法益方面与环境刑法具有一致性,在犯罪和刑事责任方面与环境刑法存在一定冲突。二者的冲突为民族自治地方环境刑事变通立法提供前提和理由,二者的契合则提供可融合的资源和智识。民族地方环境刑事立法应遵循创新性、综合性等原则,对某些危害生态环境的犯罪行为,可采取犯罪化、部分犯罪化或者轻罪化的变通进路,构建宽严相济的民族地区量刑情节体系,用少数民族语言翻译珍贵动植物名录。民族环境刑事变通立法,对于充分激发民族区域自治制度优势、切实发挥少数民族环境习惯的生态环境治理作用、生态文明法治建设具有重要意义。

外文摘要：In their long-term production and life,Zhuang,Tibetan,Uygur,Mongolian,Hui,Yao,and other ethnic minorities respect nature,protect nature,and live in harmony with nature,forming extremely regional,ethnic,and ecological environmental habits.The environmental habits of ethnic mi?norities are consistent with the environmental criminal law in terms of sanctions,value orientation,and protection of legal interests,and conflict with environmental criminal law in terms of crime and criminal responsibility.The conflict between the two provides the premise and reason for the environ?mental criminal flexible legislation of the ethnic autonomous areas and the combination of the two provides the resources and knowledge that can be integrated.Environmental criminal legislation in ethnic areas should follow the principles of innovation and comprehensiveness.For certain criminal acts that endanger the ecological environment,alternative approaches can be adopted to criminalize,partially criminalize or misdemeanor,construct a system of sentencing circumstances in ethnic areas with both leniency and strictness and translate the list of precious flora and fauna in minority lan?guages.Legislation of criminal flexibility for ethnic environments is of great significance for fully stimulating the advantages of the ethnic regional autonomy system,giving full play to the ecological environment governance of ethnic minorities’environmental habits,and building the ecological civili?zation and the rule of law.
